OFTRADE.APP welcomes you!
The portal, www.oftrade.app.com (“Website”), and the mobile application ‘Oftrade.app’ (collectively “Platforms”) are managed and operated by Parallel Space Studio Private Limited (“Oftrade.app” or “We”), a private limited company incorporated under the Companies Act, 2013, with its registered office at India and warehouse at Oftrade.app is engaged in the wholesale and retail trade in the home improvement sector, as well as the sale of their allied and auxiliary products (“Products”) through brick and mortar stores and through its Platforms, as well as providing other home design and decor solutions (collectively as “Services”) to Platform users (“User” or “You”).
THE PLATFORMS’ TERMS AND CONDITIONS OF USE
The terms and conditions of use (“Terms of Use”), as well as the applicable policies incorporated herein by reference, comprise a legally enforceable agreement between You and Oftrade.app in connection with your access to or use of the Platforms. You must carefully read these Terms of Service before accessing or using the Platforms.
Cancellation, Return, and Refund Policy Cancellation, Return, and Refund Policy
Oftrade.app reserves the right to update, modify, alter, or change these Terms of Service (or any portion thereof) at any time, with or without previous notice. It is Your obligation to review these Terms of Use on a regular basis for updates and changes, and Your continuing use of the Platforms will be deemed Your acceptance of such updates and changes.
Accessing, browsing, or otherwise using the Platforms shall be understood as Your unequivocal and irrevocable agreement and understanding of the terms and conditions set forth in these Terms of Use and the binding policies that accompany them. By using the Platforms, You express Your acceptance of these Terms of Service, declare that You have thoroughly read, comprehended, and agree to be legally bound by them. If You do not agree or wish to be bound by these Terms of Use at any time, You may not access or use the Platforms. We provide You a personal, non-exclusive, non-transferable, limited licence to enter, access, and use the Platforms as long as You comply with these Terms of Use.
This document is an electronic record under the Information Technology Act of 2000 and the rules enacted thereunder, and it has been published in accordance with Rule 3 of the Information Technology (Intermediaries Guidelines) Rules, 2011. A computer system generates this electronic record, which does not require any physical or digital signatures.
You may be required to comply with the terms and conditions of third parties whose links are contained/embedded in the Services in addition to these Terms of Use. Oftrade.app expressly states that it will not be held liable for any transaction between the User and any such third parties.
ACCESSING, BROWSING, OR OTHERWISE USING THE PLATFORMS CONSTITUTES YOUR AGREEMENT TO ALL OF THE TERMS AND CONDITIONS SET FORTH IN THESE TERMS OF USE, SO PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE PROCEEDING.
REGISTRATION
Registration. To use the Services or some features on the Platforms, You may be asked to register and create an account (“Account”). Registration is a one-time event that is free of charge. You can establish an Account and register in one of the following ways:
By making an account on Oftrade.app, you are giving the necessary information for the construction of Your Account on the Platforms. Following that, Oftrade.app will create an account for You with an exclusive user name and password (based on Your inputs).
We may, but have no obligation to, request verification of Your Account and information provided by You at our sole discretion; therefore, it is advisable to supply valid and correct information, such as an email address or mobile number, when creating an Account. You agree that if You provide any information that is false, incorrect, out of date, or incomplete, We have the right to suspend, terminate, or block access to Your Account on the Platforms forever.
You give Us permission to:
*Acquire, utilise, distribute, process, and retain all information provided by You, including Your IP address, IMEI number, and MAC address of the device from which the application was accessed;
*Verify and confirm information in Your profile, either directly or through third parties; contact You using the information in Your profile and provide promotional materials that may be of interest to You; use any and all of the information provided by You to create Your profile; and modify, limit, or delete Your profile as necessary.
WARRANTIES AND LIMITATIONS FOR USERS
You agree to use the Platforms solely for legitimate and lawful purposes and not to engage in any behaviour that is illegal or damaging to the Platforms or its content. Subject to these Terms of Use, you are granted a restricted licence to access and use the Platforms solely for the purpose of receiving Services. You must not:
Delete or modify any content on the Platforms, including but not limited to information about the Services, their performance, sales, or pricing, legal notices, disclaimers, or proprietary notices such as copyright or trademark symbols, logos, that You do not own or have express permission to modify.
Decompile, reverse engineer, or disassemble the content; collect data from the Platforms using automated systems or data mining, robots, or similar data gathering and extraction techniques;
indulge in any fraudulent traffic generation tactics, such as the use of robots, spiders, auto-spawning browsers, auto-reloading, meta refreshes, or any other kind of fraudulent and fake traffic;
engage in deceptive, fraudulent, anti-competitive, or other illegal means to meet the criteria of the other User;
without Our prior written authorization, engage in commercial activities and/or sales such as contests, sweepstakes, barter, advertising, and pyramid schemes, or the buying or selling of “virtual” products relating to the Platforms;
circumvent or attempt to circumvent or manipulate our Platforms, Services, registration process, or billing system;
print, distribute, share, download, duplicate or otherwise copy, delete, vary or amend or use any data or information posted by any User other than You; use or attempt to use another person’s profile;
attempting to gain unauthorised access to any portion or feature of the Platforms, or to any server, computer, network, or to any of the Services through hacking, password “mining,” or any other illegitimate means; probing, scanning, or testing the vulnerability of the Platforms or breaching the security or authentication measures on the Platforms; using the Services in any way that is unlawful, or harms Oftrade.app or any other person or entity, as determined solely by Oftrade.app
Post, copy, submit, upload, distribute, or otherwise transmit or make available any software or other computer files that contain a virus or other harmful component, or otherwise impair or damage the Platforms and/or Services or any connected network, or otherwise interfere with any person’s or entity’s use or enjoyment of the Platforms and/or the Services;
Engage in any antisocial, disruptive, or destructive behaviour, such as “flaming,” “spamming,” “flooding,” “trolling,” “phishing,” and “griefing,” as those terms are commonly understood and used on the internet; or Post or upload any content that is libellous, defamatory, abusive, threatening, harassing, hateful, and offensive, or otherwise violates any law or right of a third party.
Do not host, display, upload, modify, publish, transmit, update, or share any information on or through the Platform that: belongs to another person and to which they have no right; is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libellous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling
impersonates or defames another person; or contains software viruses or other computer code, files, or programmes designed to interrupt, destroy, or limit the functionality of any computer resource.
You are solely responsible for keeping Your Account details private and preventing access to Your computer, mobile device, or other similar device to prevent unauthorised access to Your Account. You must keep Your password and Account secure and ensure that no one else has access to them. You agree to accept responsibility for any and all activities that take place under Your Account or password. It is Your duty to keep Your Account information up to date and correct. You agree to take all reasonable means to keep Your password safe and secure, and to (a) promptly notify Oftrade.app of any unauthorised use of Your Account or any other security breach; and (b) ensure that You exit from Your Account at the conclusion of each session. Oftrade.app is not responsible for any loss or direct or indirect damage caused by the User’s failure to comply with these terms. You may be held liable for any losses suffered by Oftrade.app or any other user as a consequence of unauthorised use of Your Account as a result of your failure to maintain Your Account information private and confidential.
Transactions on the Platforms are only open to those who are legally competent to contract under the Indian Contract Act of 1872. You represent and warrant to Oftrade.app that: (a) you are 18 (eighteen) years of age or older and are not “incompetent to contract” under the Indian Contract Act, 1872; (b) your use of the Platform and/or Services will not violate any applicable law or regulation; and (c) all information submitted to Oftrade.app in connection with the Platform and/or Services is true and accurate. Oftrade.app reserves the right to terminate Your Account and/or deny You access to the Platforms if it is discovered that You are incompetent to contract under the Indian Contract Act, 1872, or that the information provided by You is inaccurate, or if You violate any applicable laws.
PLATFORM CONTENT
All information, content, material, text, graphics, images, videos, illustrations, logos, button icons, software code, interface, design, and the collection, arrangement, and assembly of the content on the Platforms or any other Services contained on the Platforms (“Content”) are and will remain the sole and exclusive intellectual property of Oftrade.app or the relevant third party, as applicable, and are protected by copyright, trademark, and other applicable laws. Furthermore, any trademarks, service marks, trade names, trade secrets, and Content relating to the Platforms, whether or not displayed on the Platforms, are owned by Oftrade.app or a third party.
You agree to protect Oftrade.app proprietary rights as well as the proprietary rights of all others who have rights in the Services, as well as to comply with all reasonable written requests made by Us or Our suppliers and licensors of Content, or otherwise to protect their and others’ contractual, statutory, and common law rights in the Services.
Without the express written permission of Oftrade.app, no Content from the Platforms or any part thereof may be copied, modified, altered, reproduced, republished, uploaded, posted, transmitted, broadcasted, distributed, sold, or transferred (whether in whole or in part), and You must not assist any other person to do so in any way. Any unauthorised usage results in the termination of the permissions granted in these Terms.
You acknowledge that the Services contain original works and that they have been developed, compiled, prepared, revised, selected, and arranged by Us using methods and standards of judgement developed and applied with significant time, effort, and money, and that they constitute valuable intellectual property of Oftade,app. You further agree that the Services may contain information that Oftade.app has classified as confidential, and that you will not divulge such information without Oftrade.app prior written consent.
The Content on the Platforms and Products is solely for Your personal use. The use of the Content on any other website / networked computer environment or for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks, and other proprietary rights and is strictly prohibited without the prior written consent of Oftrade.app.
The User shall not change the Content in any way, nor shall the User reproduce, exhibit, publicly perform, distribute, reverse engineer, or otherwise use the Content for any public or commercial purpose or for personal gain. Oftrade.app grants You permission to view and access Content solely for the purposes of identifying Products, making purchases of Products, and processing returns and refunds in line with the Return and Refund Policy. As a result, Oftrade.app offers You a limited, revocable licence to access and use the Services.
It is expressly stated that You will own and be fully liable for any content, review, feedback, comments, photos, videos, text, data, or other material published, posted, communicated, or stored by You on the Platforms (“User Content”). You hereby grant Oftrade.app a royalty-free, perpetual, irrevocable, non-exclusive, unconditional, and worldwide right and licence to use, adopt, reproduce, disseminate, transmit, distribute, modify, copy, use, create derivative works from, display worldwide, or act on any User Content in any form, media, or technology now known or later developed, for the full term of any rights that may exist in such Use.
To the best of his or her knowledge and belief, the User declares that the User Content given by him or her is true, correct, and complete. The User agrees and acknowledges that he or she will be fully accountable for any inaccuracy or variation from the original at a later time.
You may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form), or remove, conceal, or obliterate any copyright or other proprietary notice or source identifier, including the size, colour, location, or style of any proprietary mark(s). Without the prior written approval of Oftrade.app and/or its affiliates, you may not use any meta tags or other “hidden text” containing Oftrade.app or its affiliates’ names or trademarks. Any illegal use will result in the revocation of the authorization or licence given by Oftrade.app and/or its affiliates, as applicable.
Any infringement would result in appropriate legal procedures being brought against You in an appropriate forum to seek all available/possible remedies under the laws of the country of violation. Except as expressly authorised by Oftrade.app , you may not edit, reproduce, publicly display, or exploit any of the Oftrade.app Content in any form or manner.
You release and indemnify Oftrade.app and/or any of its directors, officers, and agents from any cost, damage, responsibility, or other consequence of any of the Platforms’ Users’ activities, and expressly waive any rights You may have in this regard under any relevant legislation. Despite its reasonable efforts, Oftrade.app cannot accept responsibility for or control the information posted by third parties on the Platforms. Such information may be objectionable, hurtful, inconsistent, inaccurate, or deceptive to you. When utilising the Platforms, please exercise caution and trade safely. Please keep in mind that interacting with someone acting under false pretences may pose hazards.
PLATFORM APPLICATIONS
The display of products for sale on the Platforms is only an invitation to offer. An order for the purchase of a Product placed by You constitutes an offer. All orders submitted by You on the Platforms are subject to the Product’s availability, Oftrade.app acceptance of Your offer, and Your continuous compliance with these Terms of Use. You understand and agree that You are accessing the Platform’s Services at Your own risk and exercising Your best judgement before entering into any transactions through the Platform. You may place orders for the Products and at the prices mentioned on the Platform.
Such offer to sell is subject to Oftrade.app repudiation at any time prior to the delivery of the Product to the User, without any obligation to assign or provide any explanation for such repudiation, without the User’s approval, and without any liability or obligation to the User. You acknowledge and agree that Oftrade.app has the right to cancel any transaction, listing, or acceptance (a) for any reason in accordance with the Terms of Use, or (b) in response to a legislative, quasi-judicial, or judicial order or instruction.
The Product’s pricing is shown in Indian Rupees. Unless otherwise noted, the price includes all relevant taxes, including GST, customs duty, excise duty, and any other tax or levy that the User may be required to pay in connection with such a transaction. The price is supplied on a ‘as is’ basis on the Application. Price errors may occur due to technical reasons, which Mistry may correct.Store at any time, and any acceptance of an offer of sale by Users of the Products subject to such erroneous selling price shall, at Your discretion, not be a legitimate acceptance, and You may avoid such Transaction.
You accept and recognise that You will be required to pay for the Products and/or Services that You obtain through the Platform. Oftrade.app takes credit card, debit card, net banking, digital wallets, and other payment methods as made accessible by the Platforms from time to time. Payments made by You through the Platforms for the acquisition of Products and/or Services are subject to the Fees and Payment Policy, which is incorporated by reference herein.
We reserve the right, but are under no obligation, to limit the sale of the Products or Services to any individual, geographic location, or jurisdiction. We may exercise this privilege on an individual basis. We have the right to limit the number of Products or Services that We provide. Oftrade.app reserves the right to change any and all product descriptions or pricing at any moment without notice. We have the right at any moment to discontinue any Product.
We do not guarantee that the quality of any items, services, information, or other material purchased or accessed by You will meet Your expectations, nor do we guarantee that any errors in the Service will be repaired. Oftrade.app is not liable for any product damage or for products that are out of stock, unavailable, or back ordered.
WARRANTIES ON PRODUCTS
The warranties and after-sales services associated to the Products, if applicable, are subject to the terms supplied by the Manufacturer of the Products. Oftrade.app has no influence over such guarantees, plays no determining part in them, and hence is not liable for the consequences of such warranty conditions.
The User recognises that prior to making an order for a Product, the User conducted due diligence and a background check on the makers of the Product, their creditworthiness, the genuineness of the Product, and is entering into the transaction knowing the manufacturer’s warranty terms.
Oftrade.app shall not be liable or responsible for the manufacturers’ actions or inactions, nor for any breach of terms, representations, or warranties by the makers of the Products, and expressly disclaims all duty and obligation in that regard.
LINKS TO THIRD PARTY WEBSITES
Third-party links on the Platforms may take You to websites not associated with Oftrade.app. We are not responsible for inspecting or analysing the content or accuracy of third-party materials or websites, nor do we warrant or accept liability or responsibility for any third-party materials, products, or services.
We are not accountable for any injury or damages resulting from the purchase or usage of goods, services, resources, material, or any other transactions conducted through any third-party websites. Please carefully review and understand the third-party’s policies and procedures before engaging in any transaction. Third-party product complaints, claims, concerns, or questions should be directed to the relevant third-party.
WARRANTIES ARE DISCLAIMED
Oftrade.app will make every effort to ensure that access to and usage of the Platforms is error-free. Your access to the Platforms, however, may be suspended or limited to allow for repairs, maintenance, or the introduction of new facilities or services. Please keep in mind that Oftrade.app is not responsible for any access or use issues caused by internet-related issues on Your end. Oftrade.app maintains the right, at any time and in its sole discretion, to prohibit access to the Platform, terminate accounts, remove or modify content.
Oftrade.app provides visual representations on the Platforms, such as graphics, illustrations, photographs, images, videos, charts, screenshots, infographics, and other visual aids, to assist you in recognising the Products of Your Choice. While reasonable attempts are taken to give accurate visual representations of the Product, Oftrade.app disclaims any guarantee or warranty of the exactness of such visual representation or description of the Product, with the actual Product eventually delivered to You. We have made every attempt to display the colours and images of our products that show in the store as precisely as possible. We cannot guarantee that the colours displayed on your computer monitor will be accurate. The look of the Product upon delivery may differ for a variety of reasons.
The Services included on or otherwise made accessible to You through the Platforms are given “as is” and “as available” without any express or implied representations or guarantees, unless otherwise noted in writing. Oftrade.app offers no warranty or representation, and expressly disclaims all responsibility and liability for any damage to Your computer system, mobile device, tablet, or other similar device, data loss, or other injury resulting from Your access to or use of the Platforms.
Oftrade.app makes no representation or warranty that:
The Services will be available around the clock. Oftrade.app shall have no liability to You for any interruption or delay in access to the Platforms, regardless of the cause; that the operation of the Platforms, including the functions contained in any Content, information, and materials on the Platforms or any third-party sites or services linked to the Platform, will be uninterrupted, timely, or error-free, that defects will be corrected, or that the Platforms or the servers that make such Content, information, and materials available will be uninterrupted, timely, or error-free.

The Products have a specified merchantability, merchantable quality, and are fit for a certain purpose. On occasion, information on our Platforms or Services may contain typographical mistakes, inaccuracies, or omissions relating to Product descriptions, pricing, promotions, offers, shipping charges, transit times, and availability. We reserve the right, at any time (including after You have submitted Your order), to correct any mistakes, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service or Platforms is erroneous. Except as required by law, we make no commitment to update, change, or clarify information in the Service or on the Platforms, including price information.
CONTENT CREATED BY USERS
You may post comments, write reviews, provide special submissions (such as contest entries), creative ideas, suggestions, proposals, plans, or other materials, or any other user generated content (“UGC”) online, by email, by postal mail, or otherwise. As a result, UGC may be present on the Platforms. Oftrade.app makes no claim to the text, data, images, including photos, videos, sounds, musical works, or UGC that You may upload or publish on the Platform. After posting any UGC on the Platform, You retain ownership of any rights they may have in that UGC, subject to the limited licence set forth below.
You agree that Oftrade.app may, at any time and without limitation, edit, copy, publish, distribute, translate, and otherwise utilise any UGC that You provide to Oftrade.app in any form. We are and shall be under no duty to (1) keep any UGC confidential; (2) compensate for any UGC; or (3) reply to any UGC.
You represent and warrant that: (i) your comments will not infringe on any third-party’s rights, including copyright, trademark, privacy, personality, or any other personal or property right; and (ii) your comments will not infringe on any third-party’s (ii) Your comments will not contain libellous, defamatory, or otherwise unlawful, abusive, or obscene material, nor will they contain any computer virus or other malware that could disrupt the functioning of the Services or Platforms in any manner. (iii) You shall not use a fraudulent e-mail address, pose as someone other than yourself, or otherwise mislead Oftrade.app or third parties as to the origin of any UGC (iv) the UGC is accurate;(v) the use of the UGC You give does not violate any applicable Oftrade.app policies or guidelines or the Terms of Use and will not cause harm to any person or entity; and (vi) the UGC is legal. You agree to indemnify Oftrade.app for any claims filed against it by a third party originating from or related to a violation of any of these warranties.
You are solely responsible for the accuracy of any UGC you post to Oftrade.app. We accept no responsibility and assume no liability for any comments or User Generated Content (UGC) submitted by You or any other party.
Oftrade.app will do its utmost to monitor, alter, or remove such UGC where appropriate or necessary. Oftrade.app makes no guarantee that any UGC on the Platform is accurate, full, or up to date, that it will not offend or disturb anybody, or that it will not infringe on third-party intellectual property rights. Oftrade.app maintains the right, but not the duty, to monitor, edit, or remove any content at its sole discretion. if we determine in our sole judgement that any UGC violates the Terms of Service, any third-party intellectual property rights, or applicable laws, or if the UGC is abusive, offensive, unlawful, threatening, libellous, libellous, pornographic, obscene, or otherwise objectionable. If You notice any offensive, abusive, or illegal content on the Platforms, You may report it to the grievance officer listed below.
CONTENT CREATED BY USERS
We are committed to deleting any listings or content on the Platforms that violate others’ intellectual property rights. We have a verification process in place to help users who are intellectual property owners report listings or content that infringe on their rights. If You suspect that any of our Users have violated Your intellectual property rights, please contact us immediately at contact us contact@dwellkraft.com and include the following information:
Description of the allegedly infringed intellectual property right, coupled with sufficient information to identify the intellectual property, including URL or screen images of the listing / content on our Platforms;
Details proving that the complainant owns or has an exclusive licence to the infringed intellectual property;
Details about the individual responsible for posting the listing/content that infringes Your intellectual property, if known; Your address, phone number, and email address.
We shall respond to all infringement notices and will follow all applicable laws in order to remove such listings or content from the Platforms. We also have the right to terminate a User’s account if such infringement occurs.
When You send Us an infringement notice, You: (i) declare that all statements made by You are true; (ii) acknowledge and agree that We may share Your infringement notice with third parties, including the parties involved in the allegedly objectionable / infringing activities, our group companies, our legal advisors, and other third parties; and (iii) You agree to indemnify Us if Your notice is issued with malicious intent and we suffer any losses as a result.
We will verify the allegations upon receipt of Your report, and if We discover that the alleged listing / content is infringing Your intellectual property rights, We will delete the listing / content within 48 (forty-eight) hours of receiving Your notice. Oftrade.app decision in this regard shall be final and binding.
Oftrade.app reserves the right to reinstate the Product’s listing if You are unable to demonstrate that the alleged listing / content infringes Your intellectual property rights. We are also not required to react to any additional takedown notices relating to the same alleged infringements.
POLICY ON PRIVACY
Our Privacy Policy, which is incorporated herein by reference, governs your submission of personal information via the Platforms.
LIABILITY LIMITATION AND INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Oftrade.app, its affiliates, holding companies, group companies, subsidiary companies, officers, directors, employees, consultants, licensors, agents, and representatives from and against any and all third-party claims, losses, liabilities, damages, and/or costs (including reasonable attorney fees and costs) arising from Your access to or use of the Platform or the Services, violation of these Terms, or infringement of intellectual property rights. Oftrade.app will promptly notify You of any such claim, loss, liability, or demand, and in addition to the foregoing, You undertake to give Oftrade.app with reasonable assistance in fighting any such claim, loss, liability, damage, or cost, at their expense.
To the fullest extent permitted by law, Oftrade.app and any of its affiliates, holding companies, group companies, subsidiary companies, directors, officers, employees, agents, contractors, or content or service providers (collectively, the “Oftrade.app Representatives”) shall not be liable to You for any direct, indirect, special, incidental, consequential, exemplary, special, remote, or punitive damages, including, but not limited to, lost profits. Include, but not limited to, any errors or omissions in the Content, materials, and functionalities associated thereto, the Services, information provided over the Platforms, and lost business, even if such Oftrade.app Representatives were advised of the possibility of such damages. Oftrade.app’s total liability (if any) for any damages or claims arising from any transaction on the Platforms shall not exceed the amount paid to Oftrade.app by the User for such transaction. If the prevailing laws do not permit the exclusion or limitation of liability for consequential or incidental damages, Oftrade.app Representatives’ liability shall be restricted to the greatest degree permissible by law.
Oftrade.app Representatives shall not be accountable for:
the use or inability to use the Platform and/or the Services; any content posted, transmitted, exchanged, or received on or through the Platform by or on behalf of any user or other person; any unauthorised access to or alteration or transmissions of SPI or other user data; any errors or omissions, whether on its own or on behalf of third parties; or any other matter relating to the Platform or the Services.
Oftrade.app is not liable or responsible for the conduct or inactions of other Platform users, or for any breaches of terms, representations, or warranties made by them. Oftrade.app is under no obligation to arbitrate or resolve any dispute or disagreement between two or more Platform Users.
Oftrade.app’s directors, officials, and employees are not personally liable for any activity taken in connection with the Platform or the Services.
ACCESS FROM THE OUTSIDE THE REPUBLIC OF INDIA
Oftrade.app makes no claim that the content on the Platform is appropriate for use or access outside of the Republic of India. You use or access the Platform from locations outside than the Republic of India at your own risk and are responsible for complying with the laws of that jurisdiction. Unless such waiver or permission is in writing and signed by Oftrade, no provision in these Terms will be deemed waived, and no violation excused. Any stated or implicit permission by Oftrade.app to, or waiver of, a breach by the User does not constitute consent to, waiver of, or excuse for any other different or subsequent breach.
SEVERABILITY
If a court of competent jurisdiction rules that any provision of these Terms of Use is unenforceable under applicable law, such provision will be excluded from these Terms of Use and the remainder of these Terms of Use will be interpreted as if such provision were so excluded and will be enforceable in accordance with its terms; provided, however, that in such event, these Terms of Use will be interpreted so as to give effect, to the greatest extent consistent with applicable law, to such provision.

RULE OF LAW AND DISPUTE RESOLUTION
